摘要:近几年来小产权房的法律问题已经成为社会关注的焦点。我国对于小产权房暂时还未出台明确的法律规定,随着房地产市场的发展小产权房的问题也越来越多。住房是最重要的民生问题之一,所以对于如何解决小产权房的问题不是全部否定它,而应根据不同的情况进行处理和管制。根据我国的国情,调整土地补偿制度,使农村集体土地的管理和使用更加完善,更好的保障农民的权利和利益,从根本解决小产权房的问题。

Abstract:In recent years,the legal issues about informal house property have become the focus of attention of the society.Informal house property hasn’t been clearly defined by law, the informal house appears many problems with the development of the real estate market. It is one of the most important livelihood issues that people live in their own house.So,we shouldn’t deny it all in terms of solving the problem of informal house,and we should regulate and control it according to different conditions. According to China's national conditions, adjustment of land compensation system, to make the management and use of rural collective land more perfect, better protection of farmers' rights and interests, and fundamentally solve the problem of the informal house.

“小产权房”是在我国二元土地制度下产生的一类住房,它并没有相关明确的法律规定,不受法律保护,但小产权房的市场却逐年增长甚至已形成规模,它的存在说明小产权房在房地产市场中是被需求的。而它的情况多样使得将其合法被利用需分类处理。如何保障好农民的权益、完善开发利用土地制度、保护耕地以及保护低收入购房者的利益这些问题是解决小产权房所要权衡的。小产权房的合法化利用将有利于解决现存的问题,但又应出台相关法律法规对于小产权房加以规范。构建有中国特色的房地产基本法律制度。
