Abstract: Translation is an inter-cultural communication which has strict practicing rules and principles. This work must be done based on consummate theories. During many theories developed by worldwide scholars in this field, Eugene A. Nida’s “Functional Equivalence” theory is one of the most accepted and useful theories. Nida pointed out that the translation work is to reproduce the most suitable and fluent information equivalent to the formal information in the target language.
Legal translation, an interdisciplinary activity, involves many fields as linguistics, translation studies, law and so on. Therefore, demands on the overall quality of the translator are high, not only profound language and translation skills, but also fairly deep law attainments. This paper applies Nida’s well-known “Functional Equivalence” theory to the legal translation that perhaps many people are not familiar with, so as to achieve a good integration between different disciplines, and between theory and practice.

摘要:翻译是一种实践性和原则性都很强的跨文化交际活动,该活动必须基于完善的指导理论基础上进行。东西方各国学者提出的众多理论之中,尤金·奈达的“功能对等”理论是目前最为公认的适用理论之一。奈达认为:“翻译就是在译语中再造出意义上和风格上与原语信息最切近而又自然流畅的对等信息。”
作为一项跨学科的翻译活动,法律翻译涉及语言学、翻译学和法学等多个领域。因此对译者的综合素质有很高的要求,不仅要有深厚的语言和翻译功底,还需要相当深厚的法学造诣。本文通过将大家熟悉的奈达的“功能对等”理论应用到很多人不甚熟悉的法律翻译中,以期达到不同学科之间良好的融合状态以及理论与实践相辅相成的状态。
