摘要:劳动合同试用期是劳动合同履行过程中的一个特殊阶段,它对于规范劳资双方的权利义务,建立和谐稳定的劳动关系有着极其重要的意义。我国现行的《劳动合同法》有关劳动合同试用期的法律规制,虽然在平衡劳动者与用人单位的权利和义务方面起到很大的作用,但仍然存在一些缺陷。本文结合我国已有的法律法规,比较研究了国外劳动合同试用期制度的相关规定,提出了完善只能约定一次试用期规则和明确劳动合同预告期规定等几个方面的具体措施,以期完善我国劳动合同试用期制度。

Abstract:The probation period of the labor contract has very important significance for the labor contract the parties. It helps to establish a stable and harmonious labor relation. What is more ,it is helpful to the adjustment of labor relations of labor rights and obligations of both parties. The current ”Labor Contract Law” has been made a lot of progress in legal regulation of the probation period of the labor contract to balance the rights and obligations of the workers and employers in China. But there are serious shortcomings which are mainly embodied in the regulation on the period of probation, a minimum wage standards of the probation period of the labor contract, the conditions to terminate the contract, and the compensation for violation of probation period. The paper puts forward corresponding measures to improve them.

试用期是用人单位和劳动者双方在合同中约定的试用工作的期限,即用人单位和劳动者为了相互了解、选择而约定的一定考察期。可以看出,试用期应是用人单位与劳动者共同感知的期间,应由劳动合同双方当事人共同确定,不应当由一方随意确定。约定试用期的目的有两个方面,一方面可以维护用人单位利益,为每个工作岗位找到合适的劳动者;另一方面,可以维护新员工的利益,使被录用的员工有时间了解用人单位的工作内容、劳动条件、劳动报酬等是否符合法律的规定和劳动合同的规定。双方当事人通过试用期内劳动合同的履行来相互了解,以便劳动合同能够因双方当事人之“适格”而顺利履行。试用期是一个特殊的阶段,双方了解清楚,才能更好地合作,对于将要建立的劳动关系有着优化的作用,也是建立稳定和谐的劳动关系的重要条件。
