摘要:随着我国市场经济的不断发展和劳动制度改革的不断深入,劳动争议越来越多,也越来越复杂,同时现行的劳动争议解决机制存在的缺陷也日益显现,在计划经济体制下建立起来的 “一调,一裁,二审”制度已经明显不能适应现实的需求。
本文通过分析现行劳动争议解决机制对我国解决劳动纠纷的意义、现行劳动争议解决机制存在的问题、国外对于劳动争议解决机制的规定及对我国的借鉴意义以及完善我国劳动争议解决机制的建议四个方面来论述劳动争议案件处理机制的不足和如何完善。对此建立一个合理的,符合我国当前国情的劳动争议解决机制刻不容缓。我们应该从当前劳动争议解决机制的立法和执法上存在的问题予以纠正和解决,确保劳动争议发生后能够及时、有效的解决,维护劳动关系稳定、顺畅。

Abstract:With the development of our market economy and the deepening of the reform of labor system,labor disputes are very many and complex . The defect of china's labor dispute system is more and more obvious. The china's labor dispute system can not adapt to the needs of the society.Through the analysis of labor dispute system,the problem of the china's labor dispute system, The regulations of foreign about labor dispute system , and improve the china's labor dispute system ,we discuss the shortcomings of labor dispute system From four aspects. Establish a rational china's labor dispute system is very important . The author thinks that we should correct the problems of labor dispute system legislation and law enforcement. We can ensure that the settlement of labor disputes in time and maintain a stable labor relationship.
