摘要:2007年,我国颁布的《物权法》中确立地役权制度,这一确立,具有极为重要的意义。地役权作为一种特殊的用益物权以其独有的特性为实务界和学术界广泛探讨。借鉴国内诸多学者的学术研究成果,本文将围绕地役权与相邻关系的概念界说、地役权独有的特性以及各国立法现状等进行阐述,初步介绍地役权制度;根据现有的国内外法律规范,地役权制度兼具法定性与意定性,本文将从不同的角度分析比较地役权在具体实践中的适用范围、行使规则等,充分探讨与地役权有关的法律适用问题和有争议的难点问题,例如学术界以及实务界都关注的空间权与地役权之比较、地役权的产生能否代替相邻关系、以及关于公共地役权的诸多问题。

Abstract: In 2007, China promulgated the promulgated "Property Law" established in the easement, which to establish is extremely important. Easement as a special Usufructuary unique features of its industry and academia for the wide range of practice. Many scholars draw on the domestic academic research, this article will focus on the easement with the neighboring relations of the Definitions, the unique characteristics of the easement and the status of national legislation such as the elaborate, the initial introduction of Easement; based on the existing Domestic and international legal norms, legal easement of both statutory and qualitative meaning ,this article will compare the different point of view of the easement in the specific scope of practice, exercise rules, fully explored and the legal easement for Controversial issues and difficult problems. Such as academics and practitioners are concerned about air rights for comparison with the easement, the easement can replace the adjacent production relations, and public easements on many issues.
