摘要:物业管理在我国起步较晚、兴起时间较短,这个新兴行业的蓬勃发展给业主带来极大便利的同时,实践中物业管理纠纷和侵害业主权益的现象层出不穷,业主权利的保护已成为社会普遍关注的一个热点问题。我国《物权法》和《物业管理条例》的颁布填补了物业管理的空白,为业主权利的维护提供了法律保障,但我国法律本身存在的欠缺和配套制度的不完善使得物业管理中业主权利仍得不到充分保护。本文从研究我国业主权利保护的立法价值入手并对目前我国对业主权利保护存在的主要问题进行分析探讨,通过借鉴国外关于业主权利保护的先进之处,结合我国物业管理中的具体实践,最后提出我国业主权利保护的观点和建议。

Abstract:Because of not very long history of China's property management,the vigorous development of the emerging industry has brought great convenience for owners.Meanwhile,the phenomenon of disputes and invasion the owners'rights and interest emerge in endlessly,so the protect of owners'rights has become social issue of common concern.The enacting of“Property Right Law” and“Property Management Ordinance”had supplied a gap to integrate property management law,and had provided ensure by law to protect the owners'rights.But the laws of ordinance itself and the incomplete correlative system can not adequately protect the owners'rights. This article starts from the legislation value research to protect the owners' rights in China and to analyze the main problem that at present our country for owners of the rights protection exist,by learning from the advanced place on the owners' rights protection abroad,combined with the specific practice of property management in our country,finally proposed consummates our country to protect the owners' rights views and suggestions.
